Terms of service

1. general terms

These terms apply to all my illustration, graphic design, and streaming asset services.

My work is created exclusively in my own artistic style, as displayed in my portfolio. I don't accept requests to imitate another artist's style. I also reserve the right to decline any commission if the project does not align with my skills or values. The following are systematically declined :
♦ Graphic violence (both animal and human),

♦ War themes,

♦ Gore,

♦ Furry content,

♦ Mechas or robots.

Romantic, nude & spicy projects : I am completely open to sensually suggestive artwork, artistic nudes, or spicy scenes. However, acceptance of the project remains at my discretion, depending on the level of explicitness and requested details. Feel free to share your brief with me in advance so we can discuss it.

I'm not responsible for how my creations are used once the final files have been delivered. It's the client’s responsibility to ensure that the ordered assets comply with the terms of service and guidelines of the platforms on which they intend to use them (Twitch, YouTube, etc.).

2. COPYRIGHT & USAGE POLICY

I retain full intellectual property rights and copyright to all my creations. All my artwork includes my signature, which must not be removed, cropped, or altered under any circumstances.

Usage rights by service type :

Twitch & Streaming Assets : Prices include a personal and broadcasting license for your streaming channels and associated social media (including monetized/affiliated channels). Physical/merchandise resale is not included.
Graphic Design (Logos, Visual Identities, etc.) : Prices directly include commercial and promotional usage rights tailored to your business/project.
Illustrations : Illustrations are delivered strictly for personal, non-commercial use. For any commercial use, global promotional use, merchandising (product resale), or publishing (book covers, etc.), an appropriate commercial license must be purchased (please refer to the pricing grid on my website under "COMMISSIONS" - "PRICES").

I reserve the right to display my completed work on my website, portfolio, and social media channels. If your project needs to remain confidential until a specific date (stream debut, gift, book release, etc.), please inform me in advance so we can agree on a later publication date.

3. PAYMENT

All my prices are listed in Canadian Dollars (CAD). Due to my business structure and turnover, Saatsuki Arts is not subject to tax collection. Therefore, all prices displayed and invoiced are net amounts. Payments are securely processed via PayPal or Stripe transfer.

Full payment (100%) is required upon signing the quote before any work can begin. I will not start any sketches or preliminary work until the payment has been received. From the date the quote is signed, you have a 48 to 72-hour window to submit payment; otherwise, I reserve the right to cancel the order.

✨ Rush Orders : Any request requiring priority delivery will incur a +50% surcharge on the initial total price.
✨ Complexity : The final price may vary depending on the complexity of the request.

Note on brief changes : The service includes 2 free minor adjustments during the sketch phase. However, any major change to the initial concept (such as a complete pose change, background overhaul, etc.) will require a new quote, and the work already completed remains payable.

4. CANCELING & REFUNDING POLICY

Client-initiated cancellation :
♦ Before work begins : 100% refund.
♦ During or at the end of the sketch phase : 50% refund of the total amount (the 50% retained covers the time spent on research, composition, and initial sketching).
♦ After sketch approval : No refund will be issued, as the project is fully engaged in its final phase.

Artist-initiated cancellation :

If I need to cancel the order on my end due to a major technical difficulty or an unforeseen issue making the project unfeasible, you will receive a full 100% refund.

However, Saatsuki Arts reserves the right to terminate the project at any time in the event of disrespectful, threatening, or unreasonable behavior from the client. In such cases, to cover the time invested while settling the dispute fairly, the maximum refund will be determined by project progress :
♦ Before work begins : 70% refund (30% retained for administrative fees and slot reservation).
♦ During or at the end of the sketch phase : 50% refund (50% retained).
♦ After sketch approval : 30% refund (70% retained as compensation for work completed and damages incurred).

5. PROCESS & DELIVERABLES

Orders follow a step-by-step process :
1. Requirements gathering and quote generation,

2. Quote and Terms of Service signed by both parties,

3. Full payment of the service (within 48 to 72 hours),

4. Sketch creation and delivery (you will receive a message/email when work begins on your project),

5. Sketch approval or adjustments,

6. Coloring and final polish,

7. Completion notification and file delivery.

Revisions : Two minor adjustments are included free of charge during the sketch phase to refine the chosen concept (ex : tweaking an expression, modifying a clothing detail, slightly moving an element). Any request that alters the overall structure of the project (ex : completely changing the pose, replacing the background, starting over with a different outfit, adding a character) isn't considered a revision. It will require a new quote, and the time already spent on the initial sketch remains payable. Once the sketch is approved, the artwork structure can no longer be changed, and only color adjustments will be accepted during the coloring phase.

File formats :
✨ Final files are delivered via email or SwissTransfer, depending on file size.
✨ Twitch & Streaming : Delivered in the agreed maximum dimensions (PNG, JPEG, GIF, or MP4).
✨ Graphic Design : Delivered in appropriate formats in High Definition.
✨ Illustrations : Delivered in JPEG or PNG format, depending on the rights granted.

6. VALIDATION

By signing the service quote, the client confirms that they have read, understood, and agreed to the entirety of Saatsuki Arts' Terms of Service.
